If you've ever passed a bad check you may not have realized
that it is more than a civil issue. Depending on the circumstances
and state, a bad check can be prosecuted in a criminal manner.
A state prosecutor may even go after you for the bad check.
In many circumstances, a person who was on the receiving end
of a bad check can sue you under both civil and criminal laws.
The debt can only be collected once but by suing you under
both it increases the check holder's odds of recovery. Whether
the check holder goes after you civily or criminaly is based
on the circumstances and his desire, but ultimately they usually
just want to be paid unless there was obvious fraud involved.
